How to Search Henry County Court Records

The Clerk of Superior Court hosts case search portals for each of the main trial courts. Superior Court runs on the official Superior Court case management search, State Court on the State Court case search, and Magistrate Court on the public Magistrate docket search. Land and lien records sit in the separate Land Records System. Each portal carries the same disclaimer: the data is offered as a public service, and accuracy is the user's responsibility to confirm. The Magistrate portal is unique in that the public web docket runs in real time, and the Clerk's staff sees the same view.

Before starting, gather what you have. A case number is the fastest path. If you only have a name, write down all spellings and the approximate filing date. Identify which court is most likely to have the case based on the matter type. The Georgia Courts Data and Records page explains which court class hears which matters across the state.

The official Georgia Courts data and records portal is a useful cross-check when a Henry County case is hard to locate. It links statewide e-access tools, public defender resources, and rule sets.

Types of Henry County Court Records

Henry County court records split by court class. Superior Court keeps the heaviest case files: felony prosecutions filed by the District Attorney, divorces, equity matters, title-to-land cases, and appeals from lower courts. State Court holds misdemeanors, county-traffic citations, and civil actions that fall outside Superior Court's exclusive jurisdiction. Magistrate Court covers small claims, dispossessory, bad-check matters, and warrants. Probate and Juvenile have their own filings.

The official courts page describes Superior Court as a four-judge trial court of general jurisdiction. State Court has a five-judge bench. Magistrate Court handles the highest-volume short-form filings.

  • Civil court records: complaints, answers, motions, orders, judgments, garnishments, writs of fieri facias.
  • Criminal court records: warrants, accusations, indictments, plea forms, sentencing orders, probation paperwork.
  • Family court records: divorce petitions, parenting plans, custody orders, name changes, legitimations, temporary protective orders.
  • Probate records: wills, estate inventories, letters testamentary, guardianship and conservatorship petitions, marriage applications.

Public Access Framework for Henry County Court Records

Georgia treats court records as presumptively public under the Georgia Open Records Act, O.C.G.A. § 50-18-70 and following. The Clerk of Superior Court is the official records custodian for Superior Court files. The Clerk of State Court keeps State Court files, and the Magistrate Clerk's office keeps Magistrate Court files. O.C.G.A. § 50-18-71 sets the right of access, the response timing, and the fee structure that applies to most agency records.

The Sheriff's Open Records page applies the statute to law-enforcement files and gives a three-business-day window for the agency to determine whether records are in custody and disclosable. Copy charges for letter or legal pages cannot exceed ten cents per page. Labor is billed at the hourly rate of the lowest-paid qualified employee who can do the work, and the first 15 minutes are free.

Note: Open-records requests do not require the Clerk to create new records or summaries; the Act covers documents the office already keeps.

Sealed and Confidential Henry County Court Records

Some Henry County court records are not available through the public portals. Adoption records are sealed under O.C.G.A. § 19-8-23. Juvenile records sit behind statutory access rules in Title 15, Chapter 11, Article 9. Mental-health and involuntary-treatment files held by Probate Court are restricted. Certain law-enforcement investigative files and grand-jury material are also off-limits to the public docket.

For criminal history, Georgia uses record restriction under O.C.G.A. § 35-3-37. Restriction blocks public access to qualifying arrest and disposition entries but does not always remove them from law-enforcement databases. The District Attorney's record restrictions page and the Clerk's criminal division both link to the process. People seeking to unseal a record usually need to file a motion in the court where the case was decided.

Domestic-violence filings present another wrinkle. A temporary protective order is generally a public filing, but addresses, contact details, and safety-sensitive information about the petitioner may be redacted or restricted by court order. Probate guardianships and conservatorships may also restrict medical, financial, and incapacity information about the protected person. The safest assumption is that anything tied to a minor, an adoption, an active investigation, a sealed file, a sensitive Probate matter, or a juvenile case will not show up on the open MicroPact docket.
