Why Georgia Uses Superior Court
Georgia's six classes of trial courts include Superior, State, Magistrate, Probate, Juvenile, and Municipal Courts. Superior Court is the trial court of general jurisdiction. That means it hears the largest range of cases, including all felony criminal matters, all civil actions, divorce and equity, title-to-land disputes, and appeals from lower courts. State Court handles misdemeanors and county traffic. Magistrate Court covers warrants, small claims, and dispossessory matters. Probate Court runs estates, marriage licenses, and weapons-carry licenses. Juvenile Court handles youth matters. Municipal Courts handle city ordinance and traffic cases.
Each Superior Court sits inside a judicial circuit. Henry County is in the Flint Judicial Circuit. The judicial circuit assignment affects how grand juries are organized, how prosecutors are elected, and how cases that span more than one county are handled when a circuit covers multiple counties.

How a Case Moves Through the Henry County System
A felony case in Henry County typically starts with a Magistrate Court warrant signed on probable cause. The Sheriff or a city police department serves the warrant. Booking happens at the Henry County Jail. Magistrate Court holds a first appearance within 72 hours under Georgia rule. From there, the case moves to Superior Court for accusation or indictment, plea, trial, and sentencing if convicted. A civil action is filed at the Clerk of Superior Court and is assigned to one of the four judges. Hearings, motions, and trial follow on the assigned judge's calendar.
